Patent d\u00e1val svobodu vyzn\u00e1vat mimo katolickou v\u00edru ten v\u00edru luterskou, kalv\u00ednskou a pravoslavnou (tzv. \u0159eckokatolickou). Kdo odm\u00edtl p\u0159ihl\u00e1sit se do n\u011bkter\u00e9 z t\u011bchto c\u00edrkv\u00ed, byl potrest\u00e1n deportac\u00ed do Sedmihradska; tento trest byl pozd\u011bji zru\u0161en. Kdo se prohl\u00e1sil za ateistu, dostal 24 ran hol\u00ed apod. Svoboda vyzn\u00e1n\u00ed pro t\u0159i nekatolick\u00e9 c\u00edrkve byla stejn\u011b omezena. Sm\u011bly stav\u011bt kostel\u00edky, ale bez v\u011b\u017e\u00ed a zvon\u016f a bez p\u0159\u00edm\u00e9ho v\u00fdchodu na ulici. Rovnopr\u00e1vnosti vSech c\u00edrkv\u00ed bylo u n\u00e1s dosa\u017eeno a\u017e r. 1861.<\/strong> &nbsp;<\/p>\n<p> <!--more--> <\/p>\n<p style=\"text-align: justify;\">\u010casto se hovo\u0159\u00edv\u00e1 o spojen\u00ed \u201e\u0161avle a krop\u00e1\u010de&#8220;. Rozum\u00ed se t\u00edm v\u00fdsadn\u00ed postaven\u00ed c\u00edrkevn\u00edch \u00fa\u0159ad\u016f i aktivn\u00ed spolupr\u00e1ce moci sv\u011btsk\u00e9 a duchovn\u00ed v b\u00fdval\u00e9 rakousko-uhersk\u00e9 monarchii. Stejn\u011b zaj\u00edmav\u00e9, \u010dasov\u011b bli\u017e\u0161\u00ed a p\u0159itom m\u00e9n\u011b zn\u00e1m\u00e9 jsou podobn\u00e9 vztahy v obdob\u00ed mezi dv\u011bma sv\u011btov\u00fdmi v\u00e1lkami, za tzv. prvn\u00ed republiky.<\/p>\n<p style=\"text-align: justify;\">Pom\u011br st\u00e1tu a c\u00edrkve nebyl po znovunabyt\u00ed samostatnosti upraven a\u017e do r. 1949 jednotn\u00fdm st\u00e1tn\u00edm z\u00e1konem. I po p\u00e1du monarchie platily d\u00e1le namnoze prastar\u00e9 p\u0159edpisy, kter\u00e9 vyjad\u0159ovaly r\u016fznou formou uzn\u00e1n\u00ed r\u016fzn\u00fdch c\u00edrkv\u00ed a p\u0159izn\u00e1valy jim rozd\u00edln\u00e1 pr\u00e1va a povinnosti. N\u011bkter\u00e9 duchovn\u00ed vypl\u00e1cel p\u0159\u00edmo st\u00e1t (c\u00edrkve kongru\u00e1ln\u00ed), jin\u00ed \u017eili z r\u016fzn\u011b stanoven\u00fdch g\u00e1\u017e\u00ed (c\u00edrkve dota\u010dn\u00ed), na Slovensku trval rozd\u00edl mezi c\u00edrkvemi \u201erecipovan\u00fdmi&#8220; a uznan\u00fdmi a na Podkarpatsk\u00e9 Rusi teprve postupn\u011b doch\u00e1zelo k ru\u0161en\u00ed skute\u010dn\u00e9 roboty c\u00edrkevn\u00edm vrchnostem (koblina a rokovina). Obce, jednotlivci, ale i tov\u00e1rny (!) v nejr\u016fzn\u011bj\u0161\u00edch kon\u010din\u00e1ch st\u00e1tu byly zat\u00ed\u017eeny tzv. patron\u00e1tem, tj. povinnost\u00ed udr\u017eovat bohoslu\u017eby v n\u011bkter\u00e9m kostel\u00edku, kupovat tam v\u00edno, sv\u00ed\u010dky, kadidlo atp.<\/p>\n<p style=\"text-align: justify;\">N\u00e1bo\u017eensk\u00e1 \u0159evnivost podporov\u00e1na rozhodnut\u00edm c. k. soud\u016f nedovolovala patron\u016fm disponovat jejich majetkem ani ve prosp\u011bch celku. Tak zvonem, i kdy\u017e pat\u0159il obci, se nesm\u011blo zazvonit bez souhlasu c\u00edrkevn\u00edch org\u00e1n\u016f (n\u00e1lez z 19.3.1891). Ale ne\u0161lo jen o zvony! Nic nepomohlo ani, kdy\u017e cel\u00e1 obec vystoupila z ur\u010dit\u00e9 c\u00edrkve a zbyl jen far\u00e1\u0159 a kosteln\u00edk: st\u00e1t propl\u00e1cel z kapsy poplatn\u00edk\u016f oba d\u00e1l, z\u016fstaly jim kostel, fara, h\u0159bitov, polnosti&#8230; Velmi zaj\u00edmav\u011b byla upravena ochrana svobody sv\u011bdom\u00ed a p\u0159esv\u011bd\u010den\u00ed. \u00dastava je sice zaru\u010dovala, ale v jednotliv\u00fdch p\u0159\u00edpadech se zas rozli\u0161ovalo, zda jde o c\u00edrkev uznanou nebo recipovanou \u010di jen trp\u011bnou atd. Podkladem soudn\u00edho rozhodov\u00e1n\u00ed tu byl trestn\u00ed z\u00e1kon\u00edk z doby bachovsk\u00e9ho absolutismu vyhl\u00e1\u0161en\u00fd 27.5.1852, kter\u00fd stanovil na zlo\u010din ru\u0161en\u00ed n\u00e1bo\u017eenstv\u00ed (\u00a7122) trest do deseti let t\u011b\u017ek\u00e9ho \u017eal\u00e1\u0159e (\u00a7 123), a pak \u00a7303 z 20. 2. 1919 o ur\u00e1\u017ek\u00e1ch c\u00edrkv\u00ed a n\u00e1bo\u017eensk\u00fdch spole\u010dnost\u00ed st\u00e1tem uznan\u00fdch. Zlo\u010dinu proti \u00a7 122 se dopustil jednak \u201ekdo provozov\u00e1n\u00ed n\u00e1bo\u017eenstv\u00ed ve st\u00e1t\u011b jsouc\u00edho ru\u0161il, nebo kdo zp\u016fsobem zneuct\u00edvaj\u00edc\u00edm zle nakl\u00e1dal s n\u00e1\u0159ad\u00edm k bohoslu\u017eb\u011b zasv\u011bcen\u00fdm nebo jinak \u010diny, \u0159e\u010dmi, v d\u00edlech tiskov\u00fdch nebo roz\u0161i\u0159ovan\u00fdch spisech n\u00e1bo\u017eenstv\u00ed ve\u0159ejn\u011b opovr\u017een\u00ed prokazoval&#8220;, jednak ka\u017ed\u00fd, \u201ekdo hled\u011bl roz\u0161i\u0159ovati nev\u00edru.&#8220; \u00a7 303 zas chr\u00e1nil \u201eprovozov\u00e1n\u00ed n\u00e1bo\u017eenstv\u00ed&#8220;, p\u0159i\u010dem\u017e se n\u00e1bo\u017eenstv\u00edm rozum\u011bl i k\u0159\u00ed\u017eek v poli \u010di krop\u00e1\u010d a provozov\u00e1n\u00edm tak\u00e9 sv\u011bcen\u00ed praporu veter\u00e1n\u016f.<\/p>\n<p style=\"text-align: justify;\">P\u0159\u00edkladem, s jak jemn\u00fdmi odst\u00edny se dovedl pr\u00e1vnick\u00fd mozek za tehdej\u0161\u00edho \u0159\u00e1du probalancov\u00e1vat ob\u011bma paragrafy, je posouzen\u00ed celkem nevinn\u00e9ho v\u00fdroku: \u201eAby tedy Kristus nyn\u00ed p\u0159i\u0161el, aby u\u010dinil z\u00e1zrak a dne\u0161n\u00ed chud\u00e9 nasytil.&#8220; Mohl zakl\u00e1dat bu\u010f zlo\u010din dle \u00a7 122, byl-li pronesen v \u00famyslu Krista zleh\u010dit nebo p\u0159e\u010din dle \u00a7 303, vztahoval-li se jen na v\u00edru v z\u00e1zraky. Zlo\u010dincem se stal, kdo by postupn\u011b pop\u00edral nap\u0159. neposkvrn\u011bn\u00e9 po\u010det\u00ed P. Marie, p\u0159i\u010dem\u017e \u201etrestnost takov\u00e9ho po\u010d\u00edn\u00e1n\u00ed nelze omezit na p\u0159\u00edpady, \u017ee by byl n\u011bkdo skute\u010dn\u011b pohor\u0161en, sta\u010d\u00ed abstraktn\u00ed mo\u017enost takov\u00e9ho pohor\u0161en\u00ed&#8220; (rozhodnut\u00ed z 13. 1. 1927).<\/p>\n<p style=\"text-align: justify;\">Ochrana ur\u010dit\u00fdch c\u00edrkv\u00ed a jejich \u201eslu\u017eebn\u00edk\u016f&#8220; dle \u00a7 303 \u0161la je\u0161t\u011b d\u00e1le. Tam sta\u010dilo, aby jedn\u00e1n\u00ed pachatelovo bylo zp\u016fsobil\u00e9 vzbudit pohor\u0161en\u00ed (rozhodnut\u00ed z 16. 2. 1923), pro skutkovou podstatu nebyl nutn\u00fd zl\u00fd \u00famysl (11. 8. 1927). Chr\u00e1nily se nejen bohoslu\u017eby, ale i obr\u00e1zky svat\u00fdch. V\u00fdslovn\u011b se v judikatu\u0159e dostalo ochrany pape\u017estv\u00ed (25. 9. 1926), Janu Nepomuck\u00e9mu (22. 11, 1924) a ka\u017ed\u00e9mu k\u00e1z\u00e1n\u00ed, by\u0165 se t\u00fdkalo jen d\u011bjin \u010di pr\u00e1va (20. 10. 1922). Zato byla odep\u0159ena podobn\u00e1 ochrana p\u0159ed posm\u011bchem pam\u00e1tce M. Jana Husi (\u201eproto\u017ee \u00facta svat\u00fdch nen\u00ed za\u0159\u00edzen\u00edm c\u00edrkve \u010deskoslovensk\u00e9&#8220;, rozhodnut\u00ed z 10. 9. 1927). Neoby\u010dejn\u011b pe\u010dliv\u011b byla chr\u00e1n\u011bna c\u00edrkevn\u00ed t\u011blocvi\u010dn\u00e1 organizace Orel. Projev kn\u011bze na jej\u00ed slavnosti je \u201en\u00e1bo\u017eenstv\u00edm&#8220;, by\u0165 se ob\u00edral politikou (4. 12. 1922) a dokonce orlov\u00e9 sami jsou n\u00e1bo\u017eenstv\u00ed, jak to vypl\u00fdv\u00e1 jasn\u011b z rozhodnut\u00ed trestn\u00edho soudu z 11. 2.1925 (\u201epopouzen\u00ed k n\u00e1silnostem proti orl\u016fm jest popouzen\u00ed proti n\u00e1bo\u017eenstv\u00ed&#8220;, a zakl\u00e1d\u00e1 proto p\u0159e\u010din proti \u00a7 14 \u010d. 2 na ochranu obecn\u00e9ho m\u00edru).<\/p>\n<p style=\"text-align: justify;\">V\u00edme, \u017ee n\u011bkter\u00e9 c\u00edrkve zam\u00edtaj\u00ed p\u0159\u00edsahu jako nedovolenou pro sv\u011bdom\u00ed sv\u00fdch p\u0159\u00edslu\u0161n\u00edk\u016f. Dnes je u n\u00e1s soudn\u00ed p\u0159\u00edsaha zcela odstran\u011bna. D\u0159\u00edve ji v\u0161ak sm\u011bli nahradit prost\u00fdm pod\u00e1n\u00edm ruky jen mannonit\u00e9, a to dle dvorn\u00edho dekretu z 10. 1. 1816! Pikantn\u00edm na tom z\u016fst\u00e1v\u00e1, \u017ee u n\u00e1s p\u0159\u00edslu\u0161n\u00edci pr\u00e1v\u011b t\u00e9to c\u00edrkve prakticky nikdy nebyli a nejsou. Zm\u00edn\u011bn\u00e1 ustanoven\u00ed nepat\u0159\u00ed zdaleka k nejstar\u0161\u00edm, kter\u00e1 u n\u00e1s v oboru c\u00edrkevn\u00edho pr\u00e1va je\u0161t\u011b p\u0159ed lety platila. Tak matriky se vedly dle c\u00edsa\u0159sk\u00e9ho patentu z 20. 2. 1784, term\u00edny poh\u0159bu ur\u010dovaly dvorn\u00ed dekrety z 31. 1. 1756 a 7. 3. 1771, zp\u016fsob d\u011bd\u011bn\u00ed po vojensk\u00fdch duchovn\u00edch upravovalo zas na\u0159\u00edzen\u00ed v\u00e1le\u010dn\u00e9 rady z 20. 2. 1779. Platn\u00e9 p\u0159edpisy pro posledn\u00ed v\u016fli vysok\u00fdch c\u00edrkevn\u00edch hodnost\u00e1\u0159\u016f sahaly a\u017e k nejvy\u0161\u0161\u00edm reskript\u016fm z 5. 5. 1675 (!) a 23. 4. 1710. Pod tlakem ve\u0159ejn\u00e9ho m\u00edn\u011bn\u00ed a vlivem pokrokov\u00fdch sil do\u0161lo kr\u00e1tce po r. 1918 k odstran\u011bn\u00ed nejk\u0159iklav\u011bj\u0161\u00edch p\u0159e\u017eitk\u016f (zejm\u00e9na povinn\u00e9 n\u00e1v\u0161t\u011bvy kostela pro \u0161koln\u00ed ml\u00e1de\u017e, n\u011bkter\u00fdch c\u00edrkevn\u00edch opat\u0159en\u00ed v arm\u00e1d\u011b apod.). P\u0159\u00edchuti pob\u011blohorsk\u00fdch z\u00e1kon\u016f se v\u0161ak vymizet necht\u011blo: soud zastavil jedn\u00edm dechem penzi b\u00fdval\u00e9mu \u0159\u00edmskokatolick\u00e9mu kn\u011bzi jen proto, \u017ee se o\u017eenil (1923), ale sou\u010dasn\u011b prohl\u00e1sil neplatn\u00fdm opat\u0159en\u00ed ministra, kter\u00fd odn\u00edmal jin\u00e9mu kn\u011bzi za prok\u00e1zanou protist\u00e1tn\u00ed \u010dinnost p\u0159\u00edmo a ihned kongru\u00e1ln\u00ed doplatky (n\u00e1lez z 2. 3. 1923). Far\u00e1\u0159i i v republice pob\u00edrali d\u00e1l \u0161tolov\u00e9 odm\u011bny tak\u00e9 za \u00fakony, kter\u00e9 za n\u011b vykon\u00e1val kaplan (n\u00e1lez z 18.2.1900) a b\u00e1ba vyzn\u00e1n\u00ed \u017eidovsk\u00e9ho, kter\u00e1 neupozornila v\u010das na nebezpe\u010d\u00ed smrti d\u00edt\u011bte nebo rodi\u010dky, aby mohly b\u00fdt opat\u0159eny sv\u00e1tostmi, podl\u00e9hala d\u00e1le trestu \u201edle zaslou\u017een\u00ed&#8220; (na\u0159\u00edzen\u00ed min. kultu a vnitra ze 3. 9. 1850); kn\u011bz mohl ur\u010dit k\u0159estn\u00ed jm\u00e9no d\u00edt\u011bte proti v\u016fli rodi\u010d\u016f a to pak nesm\u011blo b\u00fdt zm\u011bn\u011bno (n\u00e1lez z 1. 6. 1904)&#8230;<\/p>\n<p style=\"text-align: justify;\">Archiv NoS<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; Skon\u010dilo vyd\u00e1n\u00edm toleran\u010dn\u00edho patentu c\u00edsa\u0159e Josefa II. z r. 1781 st\u00edh\u00e1n\u00ed nekatol\u00edk\u016f ze strany st\u00e1tu?
